    Hello,

    I bake and sell homemade cake pops and cupcakes out of my home kitchen. There is a farmer’s market near me and I would really like to apply to set up a booth and sell my products there. However, the application to get a booth requires that you have a business license and asks you for your license information. I’m new to the cottage foods law (a friend recently told me about it), but it looks like you don’t need a license in order to sell products under this law. How do I apply for a farmer’s market booth, then? Thanks for any help! :-)

    Nicole, you are not required to get a license from the health department to sell your food, but it’s very reasonable for your farmers market to require a business license. It’s the same basic license any business of any type would get, and it’s usually pretty easy — you would apply with your city or county. It’s also relatively inexpensive… probably not more than $100 per year, and maybe much less.
