Baked Beans

    My wife and I are considering marketing our baked beans. Do they fall under the cottage law if they are canned and do not require refrigeration until after opening?

    Baked beans cannot be produced under the Ohio Cottage Foods law.
    Ohio Administrative Code (OAC)
    Chapter 901:3-20 Cottage Food Production(OAC Chapter 901:3-20 Cottage Food Production)
    901:3-20-05 Prohibitions.
    A cottage food operation may not:

    (B) Process acidified and low acid canned food;

    You will need to comply with:

    1. Ohio cannery law (OAC Chapter 901:3-3 Thermally Processed Low-Acid Foods Packaged in Hermetically Sealed Containers)
    2. FDA regulations
    1. 21 CFR §108 and §113 for low-acid canned foods
    2. 21 CFR §114 for acidified foods

    Your baked beans are most likely a low-acid canned food, and thus, must be processed using a pressure process with specialized equipment. I did set up pressure apparatus for a small entrepreneur in Ohio over a decade ago, but this is an expensive proposition, and this person is no longer processing low-acid canned foods. I know of no shared use kitchen that allows processing of low-acid canned foods.
