Cottage Food Bill
This was New Mexico’s initial law for “Homebased Food Processors”. For many years, it was the strictest of all cottage food laws, which resulted in very few people using it. And some areas — most notably Albuquerque — didn’t even allow homebased food processors at all. The steps to to get a permit were very complex and were similar to what a commercial food business would have to go through, but New Mexico still restricted homebased processors to making only certain types of non-perishable foods and selling them directly at farmers markets, events, and roadside stands. In order to get a permit, a processor had to take a food safety course and get a kitchen inspection. The only good news was that there was no limit on sales.
