Reselling food from Cottage Food Licensed Vendors

    I am trying to find out if I can purchase product (i.e. jams) from a local vendor who has a Cottage Food License and include said product into a gift box that I would be selling via my website. I know that her products cannot go into a retail store, but does anyone know if I purchase at a wholesale price/in bulk, if I can include the product in my gift boxes?

    Any advice would be appreciated. I would love to promote this one particular business, but do not want to get anyone in trouble.

    Erin, as you deduced, this would be classified as an indirect sale. I understand your desire to support the business, but the intention of the law is that the end-consumer would meet the producer. I’d imagine that this wouldn’t be the case with your gift boxes. Best of luck!
