I do not think that any cottage food law is sophisticated enough to specify bartering transactions as monetary transactions that count against your sales limit. If it were me, I’d only count monetary transactions against the sales limit, and I’d be highly surprised if ignoring bartering transactions were illegal.

I am seeking kitchen space as I cannot create a domestic kitchen in my home. I live in Memphis, TN and would like to start selling my jams/chutney online.
Another question:
Does anyone know of a loophole to get around the need for a licensed kitchen by using the Cottage Food Laws?Thanks,

There isn’t any statewide, govt initiative to list all CFOs, but there are a few health depts that have lists of CFOs in their counties. Off the top of my head, I think Sacramento, LA, San Bernardino, Orange, and a few others have a list.

John, could you provide some references to back up your claim? It’s not about the requirements being “more” or “less” — it’s just that the requirements are different because they’re managed by a different dept. Grace, you can accept credit cards with your mobile device and I would recommend Square or PayPal Here.

Hi,
You can opt for mobile payment services. Certain Merchant services provide mobile payment processing app that can accept payments online. The customer also receives an e-receipt. I got a reply back from someone from the TN.gov office. They don’t know how to handle this either. They’re trying to get some information for me.

It’s a unique setup, for sure. I don’t think I’ve heard of anything quite that elaborate, though I do know CFOs who pool money to buy ingredients wholesale from existing suppliers.

Usually schools have strict rules about food that can be served on their premises, so I doubt you could do this without using a commercial kitchen. You should talk with the school and the ag or health dept.
