I was wondering on the licencing of Kratom tea? It would be a brewed beverage and also sold retail though no food would be sold and it is a non alcoholic beverage so would it be covered by this law in some sort?

All of your products need to be packaged and labeled in your home, regardless of how they’re sold. The section of the law that you mentioned is intended for a restaurant that buys your product and then integrates it into their menu. That’s great to hear, Krystle. Sometimes the health dept just doesn’t like the laws the way they are written. But it could also be that they thought they knew what they were talking about and didn’t want to admit that they were wrong. I’m glad they finally chose to allow it.

Most people find it to be easier than they expect. Make sure your kitchen is clean and there aren’t bugs in any cupboards. The inspector will let you know if anything needs to be adjusted. Jess, I understand your concerns and I know it’s frustrating. You can imagine how all of the small local bakeries felt when the cottage food law got passed… what was the point of them going thru all the setup effort a year or two ago?

Yes, you don’t need a kitchen inspection. Assuming that your county/city will require a business license, you can create a fictitious business name instead of operating under your own name.
