As long as your products contain at least 75% of your own honey, you can directly sell your honey from your home, at farmers markets, farm auctions, or government festivals within Ohio. All sales must be made in-person, and no license from the ag dept is needed. For fewer restrictions, you should contact the ag dept about becoming licensed as a…[Read more]

Since this is beyond the scope of the cottage food laws, I’m simply not familiar with the rules for this. You should contact your health dept for more info.

This would be beyond the scope of cottage food laws, and I simply don’t know. You should contact your health dept.

I don’t think that’s allowed, but you could call the health dept to see if the exemption for donated baked goods extends to online sales.
David replied to the topic Frostings in the forum Ohio 10 years, 8 months ago
It depends on the frosting. Basic frostings without dairy products should be allowed at farmers markets. To sell at specialty stores, I believe you need to produce the frostings in a commercial kitchen. For anything other than basic frosting, you need to call the ag dept at 800-282-1955 ext 4366 for more info about what’s allowed.…[Read more]

David replied to the topic Taxes under cottage food law in the forum Virginia 10 years, 8 months ago
You need to pay annual taxes on all income you make, even if your business is operating at a loss. There is no limit — technically, your first order should have been reported. If you want to bypass income tax requirements, you would need to give away your products (not collect money). Once you start making a certain amount of money, you need to…[Read more]

David replied to the topic seling bulk dry goods in the forum Pennsylvania 10 years, 8 months ago
Unless there is some special permit for repackaging commercially-produced foods, I think you would at least need to become a limited food establishment — I think those foods would be allowed, but I’m not completely sure. It’s best to contact the ag dept directly and ask them about your specific situation.

You need a commercial kitchen to do this, and it wouldn’t fall under the cottage food law. It’s only possible to do at home if you build a commercial kitchen on your property. http://forrager.com/faq/#commercial

I have a business venture that I would like to pursue (2 options). I want to prepare meals for people with different needs, primarily gluten free. I don’t know if this falls under PA Cottage Law? I would like to get an inspection (whatever type applies) prepare and package the food in my home. The meals would be delivered to my clients once a…[Read more]

David replied to the topic Croutons in the forum Ohio 10 years, 9 months ago
If you add the butter and then thoroughly bake the croutons, that would definitely be allowed. If you are adding the butter after baking, it would still likely be allowed, but you should check with the ag dept.

Hi! New here, but I’ve been also researching Virginia’s cottage food laws. Regarding buttercream – unlike the hard stance Virginia takes on cream cheese, the law doesn’t specifically address buttercream so it is a gray area. The key is whether you need to refrigerate it, which mostly depends on the exact ingredients you use and the proportions.…[Read more]

I want to sell my homemade fudge at farmers markets and festivals. Is this allowed in WV? Also, I live on the border of OH and PA. Can I sell my fudge at farmers markets and festivals there? Do I need to label the ingredients used? Does this need to be on each piece?
I do not think that fudge is allowed in WV, but you should call the ag dept to double-check. You wouldn’t be able to sell across state lines either. It would probably be best for you to setup a commercial business. http://forrager.com/faq/#commercial
