Hi there,
I wish my first update of 2020 could be a positive one, but unfortunately, I have some bad news to share.
Basically, the health department in
North Dakota used their agency powers (probably illegally) to override their state's food freedom law (created in 2017).
Now, North Dakota's law has actually regressed and is no longer a food freedom law, but is a pretty good cottage food law instead.
As far as I can recall, this is the first time a cottage food law has regressed!
As you can imagine, this has created waves in the cottage food community, as well as a lot of discussion about what rights government agencies should have to change laws.
To learn more about what happened, you can read my analysis in this blog post:
North Dakota Loses Food FreedomYou can also get all of the details about the new update on
North Dakota's law page.
Hopefully, the supporters in North Dakota can pass a new bill soon to return their food freedom law to its former glory!
Also, to start the new decade, I am simplifying my approach to email. Previously, I sent two types of emails: this newsletter one, and also one whenever I added a new blog post (for those who signed up for blog updates).
Moving forward, I will simply send this newsletter, and whenever I add a new blog post, law page, podcast episode, or other content, I will mention it in here.
I hope your new year has been more positive than this email was! But don't worry -- my next update will be much more uplifting!
David
