1. You can advertise any way you want, but I don’t think you can sell from home or offer delivery. If you are posting photos on Instagram and selling at a farmers market, that would be fine.
2. The other option would be to use a commercial kitchen, get a license from the health dept, and run your business with any method you’d like.

I do not believe you can sell homemade items in NY if you aren’t a NY resident. You probably need to use a commercial kitchen with the appropriate license to start your business. You should talk to the farmers market in NYC to see what they require.

You should contact the ag dept about selling the teas and syrups… I don’t think you can sell them from your office. I believe you can only sell them at certain public markets and stores, so you might need to produce them in a commercial kitchen to sell them at your office.

Hello, trying to start up a small business with cakes in a jar I have been doing for my family and friends. I know I cannot use any creams in the jars just shelf stable frostings? is this correct? also wanted to know if I’m allowed to make hard candy apples? I have a food product I’d like to make myself and sell. I’m from New York, but I live in Shanghai most of the year. I’m not sure how to sell in Shanghai (a topic for another post), but I’m wondering whether it would be possible to sell foods internationally to customers in New York (and California) via the internet.

No, NY isn’t really setup for a custom food business, since they only allow sales at events and stores. The law is intended for a home cook who makes items and then brings them to an event and sells them there, or sells them to a store for resale. Yes, you should be able to sell jarred cakes with shelf-stable frosting.
You can sell uncut fruit and you can sell hard candy, so I assume that if you combine the two, that would be allowed. If you cut the apple, it wouldn’t be allowed, and even putting a stick in it might be a problem. You can call the ag dept to check.
