Homemade juices are not covered under CA’s law, and therefore, there is currently no way to legally sell homemade juices.
However, CA is in the process of reviewing submissions for adding foods to the allowed list. You can submit a request using the links below until January 31st. Keep in mind that the health dept will only approve items that…[Read more]

I could explain what non-PHF means, but that is only applicable to baked goods or confections. Basically, none of the items you’re describing, like jams or sauces, are allowed in Arizona under the cottage food law. That means that to legally sell your products, they would need to be produced in a commercial kitchen.

Hi there, I opened my CfO last year. I live in Orinda and am registered with Contra Costa. City ordinance says I can run a business from my home but clients can not come to the house. It limits me a little but not a major problem. My business plan was to delivery locally and in time get a Farmers Market stall. I started looking into this and…[Read more]

I would like to put in a request to add a new baked item to the current CFO approved list. Does anyone know the email for me to do so?
Nevermind, I found it: http://www.cdph.ca.gov/programs/Documents/fdbCFOapplication.pdf

Arizona is pretty lenient… you will be fine with this kind of item.
You don’t need a nutrition label on your products unless you make a health claim, like “low-fat”. Just apply for an exemption.
The FDA’s info confuses me too, but I know you don’t have to register with them (aside from that exemption). Sorry, I really have no idea if info…[Read more]
Thank you David !
Is it even possible to register a home based business as a FDA food facility? I am concerned if a consumer sees a ‘made in a private home’, it may discourage them from buying a product. Can a label be worded ‘made in a cottage food facility’ ? and still be legal?I found this link that may help if anyone has questions on FDA food preservative regulations.
It is .1 percent of the finished product for most common preservatives and or combination of two or more.
I am so glad I stumbled on this site. Cottage Food laws will make it so much easier to get started!Michelle, can you repost your question in the forum for all to see? This here is my activity feed, and others won’t be able to follow the conversation.

Marianne, your Class B permit is for indirect sales, and I think this would qualify for that, as long as the person selling it is doing so within your county (or in other approved counties, where the necessary agreement with the health depts exists). Indirect sales usually happen at food facilities or grocery stores, but it also includes someone…[Read more]

The problem I think some counties are having ( within Environmental Health) is interpreting exactly what the law states. The Specialist I’m in contact with most of the time admits to having trouble making sense of it all. In my county, I’m allowed to use my caramel for my caramel apple pie though when I first submitted my ingredient label for app…[Read more]

What a great resource ! I’ve been wanting to find others out there operating their own CFO’s and how they’re fairing. I don’t about anyone else but getting in and permitted at the beginning of this whole thing has given me that sense of being a ‘pioneer’ in California’s Cottage Food Industry and I’m kind of proud of that. I firmly believe that…[Read more]

Greetings!
I am an artist (oil painter) currently living in Kansas, but wanting to relocate to California for a better cultural atmosphere and work opportunities.
Because it aligns with my “do-it-yourself” sensibilities and stance against Big Corporate, I am interested in volunteering my services to a Cottage Food producer who needs the help. I…[Read more]Kelly joined the group California 12 years, 1 month ago

Jan, unfortunately Santa Clara county seems to be the most restrictive county in the state. They are very strict, at least regarding the cottage food laws.
In short, this cottage food law would not apply to you. Not that it would matter anyway… Santa Clara’s cottage food permit fees are very expensive.
Fortunately, there is an exemption for…[Read more]

As long as your caramel sauce is considered non-potentially hazardous confectionary good, then you should be able to sell as a cottage food operation using the laws described on this site. Caramel sauces may be a little more borderline, and your health department may require that it be lab-tested before approving your registration.
David replied to the topic How to ship baked goods in the forum California 12 years, 1 month ago
If you run a cottage food operation, then you can legally only make food from your home kitchen. To make your product in a commercial kitchen, you need to be operating under a different license (which would also allow you to ship out-of-state).
The reason you can’t find anything about out-of-state sales is because those are not allowed under the…[Read more]

Donna, the law just got amended on January 1st to allow CFOs to sell directly anywhere in the state. Some counties may take awhile to get up to speed with the new ruling, but eventually no county should be prohibiting CFOs from different ones. You should call up Sonoma again and see if they’re aware of AB 1252, and what they’re doing about it.
Hi David,
I am just days away from getting my LA County CFO permit Class B. The LA Dept. of Public Health told me (last week, Feb 2014) that in LA County, cottage foods from other counties are *not* permitted in retail stores.
Where did you hear about the change in the law?
Thanks!
In AB 1252 it seems to say that it is still up to each county…[Read more]
Right — the law change is only applicable to direct sales. Indirect sales have the same rules they’ve had from the beginning, which is that counties may allow intercounty sales if they choose to.
