Hi everyone :)
I’m new here and am trying to figure out if I can sell vegan nut based cheeses under cottage food laws. I see nuts are okay so how about cheeses made from nuts and other plant based ingredients? Thanks for your help!I’m not an expert on vegan cheeses, but I’m pretty sure they wouldn’t be allowed. Florida doesn’t even allow nut butters, so you will probably need to use a commercial kitchen. http://forrager.com/faq/#commercial

You’ll need to get licenses for all three (maybe not #2), but I’m not sure which ones. You must prepare the water kefir in a commercial kitchen. For #1 and #2, contact the health dept. For #3, contact the ag dept.

1. You can advertise any way you want, but I don’t think you can sell from home or offer delivery. If you are posting photos on Instagram and selling at a farmers market, that would be fine.
2. The other option would be to use a commercial kitchen, get a license from the health dept, and run your business with any method you’d like.

Deb, yes you can sell your cakes and yes, you need to register with the ag dept, and there are a number of other requirements, which you can read through on this page: http://forrager.com/law/minnesota/

I do not believe you can sell homemade items in NY if you aren’t a NY resident. You probably need to use a commercial kitchen with the appropriate license to start your business. You should talk to the farmers market in NYC to see what they require.

I should also mention that although the bill has easily passed through the House, it’s had trouble in the Senate. That often happens in states, as the two sides are intended to provide balance for each other. But it can be misleading… a unanimous passage by the House does not necessarily mean that a bill is close to passing and becoming law.
