You can only sell to customers in CO, but you can’t ship to anyone. However, you can sell online, with local fulfillment. Many CFOs run successful businesses with this local approach, without needing farmers markets. However, it may take more marketing effort and outreach on your part.

Yes, you can sell dry tea with a cottage food permit.
David replied to the topic Kombucha / Vinegar Low Acid in the forum Virginia 10 years, 6 months ago
Yes, this should be allowed for a home food processing operation, which I was not well-informed about back in February.
I don’t think any drink would be allowed under the cottage food law, and I’m not really familiar enough with starters to comment on them. My guess is that those wouldn’t be allowed either, but you should talk with the ag dept to…[Read more]

I have never heard that for Arizona. Are you sure the article was written for Arizona? If you can’t find info online about this, then you should contact your health dept for clarification. If you find that farmers can sell homemade goods, I’d really like to know!

That does not fall under the cottage food law and you will need to use a commercial kitchen to produce your items. http://forrager.com/faq/#commercial

I think that neither of those would be allowed. I’ve never made toffee before, but I always thought that it was made with a stovetop cook process, like most candy. There aren’t too many types of candy that I know of that use a baking cook process, but some do, so that’s why it’s listed as a possibility. I think you will need to use a commercial…[Read more]
David replied to the topic Flavored Sea Salt in the forum Texas 10 years, 7 months ago
Probably not. Texas has a very specific list of foods, which doesn’t include seasonings. It does allow dry mixes (combined commercially-produced ingredients), dried produce, and dry herbs, but flavored salt really doesn’t fall under any of those. You will need to contact the health dept to get approval. I don’t think the type of flavoring would…[Read more]

If you want to sell chocolate-covered strawberries, you need to prepare them in a commercial kitchen. There is no license that would allow you to do this from home. http://forrager.com/faq/#commercial

I honestly don’t know what’s technically allowed and what’s not. I’d recommend you contact your ag dept.

David replied to the topic Cake decorations that are edible in the forum Florida 10 years, 7 months ago
I would think that most simple sugar decorations would be allowed. Anything requiring refrigeration would not be allowed. If your decorations have dairy in them, I’d recommend you call the Bureau of Food and Meat Inspection at 850-245-5520.
David replied to the topic Who can I sell to? in the forum Indiana 10 years, 7 months ago
No — not if you plan on making them at home. You need to make them in a commercial kitchen and get a commercial license: http://forrager.com/faq/#commercial
David Crabill wrote a new post, Food Freedom Is No Longer A Myth 10 years, 7 months ago
Yes, food freedom is real. The term has become increasingly popular: you may have heard it around the dinner table, at farmers markets, or even at a food freedom fest. This catchphrase of locavore culture has […]

The cottage food law only pertains to food items, and I’m not sure if it allows extracts. You should contact the ag dept about making those.
I don’t know about other laws. I would expect anything that’s applied to skin to be regulated by the health dept. Laundry supplies… I have no idea. What I do know is that anytime you’re starting a…[Read more]

Usually there is some kind of exemption for charitable or nonprofit sales, but I’m not sure about sales to benefit an individual. If you are in business for yourself, that is more or less sales to benefit an individual (you), right? I don’t really know… I’d suggest you call the ag dept for more info.
David replied to the topic Store front in the forum California 10 years, 7 months ago
You don’t report sales, aside from reporting income on taxes. One protection you would get from the law is simply being a legal business, and nobody can sue you as long as you stay within the law.
The state would never have time to sue… more likely it would be a consumer or someone who didn’t like you. This is a rare occurrence that might…[Read more]
David replied to the topic Sellers Permit in Los Angeles California in the forum California 10 years, 7 months ago
Food is not necessarily non-taxable, especially at the county or city levels. Also, for events that charge an admission fee, I’ve heard that all food sold must be taxed. I’m not a tax expert, but I know that this stuff can be pretty complex and you should try to find someone in the govt who knows what they’re talking about.
You would want to get…[Read more]
