Every county is a little different. You probably do need to register a business to get a Class B permit in LA, but it shouldn’t be hard to do. At the very least, you can just become a sole proprietorship under your name. When you submit your permit application to the health dept, they will tell you whether you need to get registered with the county first.

In general, yes, you need to follow the same rules. But in this case, I haven’t confirmed that dry mixes are allowed under the cottage food law in Massachusetts, so it might be harder to start that type of business. You can contact the ag dept to determine what they will allow.

The best way to protect a name is through trademarking, but first, I would highly recommend that you don’t worry about that until you are making substantial revenue from your business. Hello, trying to start up a small business with cakes in a jar I have been doing for my family and friends. I know I cannot use any creams in the jars just shelf stable frostings? is this correct? also wanted to know if I’m allowed to make hard candy apples? I’m almost positive you need a permit to do that, but I’m not sure which one. You could do this as a limited food establishment, but you should call the ag dept to see if there’s an easier way.

Yes, you should be able to sell jarred cakes with shelf-stable frosting.
You can sell uncut fruit and you can sell hard candy, so I assume that if you combine the two, that would be allowed. If you cut the apple, it wouldn’t be allowed, and even putting a stick in it might be a problem. You can call the ag dept to check.
