Sarah, this would probably be fine as long as you are producing the food yourself and selling the items yourself. The “retail store” prohibition is referring to indirect sales being disallowed. NJ doesn’t have any cottage food rules, exemptions, etc. Since the doughnuts will be made in a commercial kitchen, this should be possible, but I’m not sure of the specific rules. CDPHE is holding what they are calling Cottage Food Stakeholder group meetings on a monthly basis in order to hear from cottage food producers/vendors. The CDPHE wants input into setting up the guidelines for the “pickled vegetables” products that will be Tier 2 food product they can make and sell but probably not until mid-2016.

CO’s health dept has chosen not to include donuts on their allowed list, which means they’re probably not allowed unless they’re baked donuts. I don’t think jam, jelly, or frosting would be an issue… I believe that anything fried would not be allowed. http://forrager.com/faq/#commercial

I have a questions regarding making doughnuts in the state of CO. First question, do doughnuts fall within the cottage law in CO and second question is what are the limits if any, regarding filled doughnuts as in Jelly, Jam and/or frosting. Any advice/help is greatly appreciated, thank you.
