I was wondering on the licencing of Kratom tea? It would be a brewed beverage and also sold retail though no food would be sold and it is a non alcoholic beverage so would it be covered by this law in some sort?

You need to make sure the cat isn’t in your kitchen while you’re preparing food for your business. Although cottage food operations cannot sell items that require refrigeration, I believe that almost any gluten item that would be allowed under the law would also be allowed if produced gluten-free. Yes, you don’t need a kitchen inspection. Assuming that your county/city will require a business license, you can create a fictitious business name instead of operating under your own name.
