You won’t be able to use the cottage food law and make your ice pops at home. You should probably double check to make sure that that Berkeley business is actually legal. http://forrager.com/faq/#commercial

The limit isn’t actively regulated, but a health or ag dept could shut down an operation if it was clear that they were making too much. I’d say it’s more self-regulated, in that people know if they make more than $15K then they’re doing something illegal. That limitation is baked right into Florida’s law, so an amendment to the law would need to…[Read more]

It should be true, but there are some counties with weird ordinances. You can check with your local ag dept, but usually you don’t need a license from them to sell produce. You may need a business license or something else from other depts in your county, though.

Bake sales like this may be possible, but it’s up to your health dept to draw the lines for what’s allowed.

One thing that complicates things is that CFOs do not need a permit from the ag dept, so most probably don’t check with the ag dept before starting their business. But from what I’ve heard, in Miami-Dade a CFO would get stopped if an inspector walked through the market.
It is actually what the law doesn’t state that matters. It doesn’t say that…[Read more]

I am interested in starting a cottage food biz – selling the items from my home or delivering directly to the customers, not at events or farmers markets…could I sell homemade, frozen casseroles to individuals that are either delivered to them or picked up at my home (these casseroles would contain meat, vegetables or cheese)? If I deliver to…[Read more]

Coconut Milk Ice Cream?
Hi, I’m wondering if it would be allowed to make ice cream from pasteurized coconut milk? There are no eggs used. Just coconut milk, xanthan gum, coconut sugar or honey and either chocolate or fruits.
Thank you.No — ice creams are not allowed. http://forrager.com/faq/#commercial

what kind of sweeteners can be used for jams under the cottage food. Am I reading it wrong or could a CFO not be able to use Stevia?

Good morning, I am in the process of getting my home occupation license in Roseville. I’ve paid for the Roseville business application, got my proof of publication for my business name, I have my kitchen floor plan and sellers permit from BOE and am scheduled to take the next Food Safety Certification Class. Can I sell at vending events now or do…[Read more]
Have you received your permit from your environmental health dept yet? If so, then you can start selling now. After you start your business, you have a 3-month window to get training. However, online training is much simpler and could happen today… unless you’d rather take a class in-person.
I wasn’t aware of the online training and I already purchashed the class for $90. bucks….darn. (i’ma checka nd see if I can get a refund.)
I’d recommend you read everything on this page: http://forrager.com/law/california/
You are essentially getting more training than is required.

I am curious about starting a business selling roasted NM Chile peppers in FL. I would like to know if I need a special permit to make HOT sauce from the peppers at the end of the season?
For selling either the peppers themselves or hot sauce made from them, you’d need a commercial license. http://forrager.com/faq/#commercial

David replied to the topic Let's pressure farmers market association to consider cottage food applicants in the forum California 10 years, 5 months ago
I think the main reason is that they just don’t need to. Farmers markets are so popular that most of them have an abundance of sellers lining up. Some have a year-long waiting list. There are also some markets that only focus on produce, which is understandable.
Farmers markets that accept CFOs are usually ones that simply like the idea of…[Read more]

No — your items can’t contain anything that requires refrigeration. Your casseroles would need to be made in a commercial kitchen. http://forrager.com/faq/#commercial
