1. No — it wouldn’t be allowed on two accounts: the cream and the cream cheese.
2. I think you can, but not under this law. I’m not sure if you need more than a sellers permit.
3. Yes, and many counties require that they be prepackaged. I have seen a number of CFOs do open samples, but I’m not sure if they’re doing so legally.
4. Probably not. If…[Read more]liz started the topic Getting Started in the forum California 9 years, 4 months ago
Hi I am planning on starting a new cottage business in San Bernardino county. I have a few questions.
1. I make an amazing whipped cream cheesecake. I realize cream can not be in my goods, but what if I bake it?
2. Can I sell bottled water along with my goods? Wouldn’t that be included with my seller’s permit?
3. Can I pass out samples? Do they…[Read more]liz joined the group California 9 years, 4 months ago

Yes, you need to get them inspected if you use a private well or septic tank.

In Florida, an inspection can only happen if a customer has a health concern/complaint. I have never heard of that happening to any CFO across the states… at the very least, it’s exceedingly rare.

Yes, you can sell thoroughly-baked items that contain fruit, like your cake, strawberry pies, or banana bread. You cannot sell cut fresh fruit.

This Saturday, July 11th, is Cottage Food Industry Day at the CA State Fair! Jen Cooper (owner of Ben and Max Homemade Snacks) is really looking for some more registered CFOs to participate that day. It would be a great way to showcase your business! Here’s some more info:

First of all, I think it’s unlikely that savory jams would be allowed under this law. The types of canned goods you can produce must have an appropriate combination of sweet and/or acidic. I don’t think there’s an instance where your jams or jellies could include vegetables. This resource should help explain what’s allowed.

I need some clarification about taking orders…. it states “direct sales only”
Does that really mean just “in-person”? We can’t take orders through website, FB or even email?Grant Rosenquist joined the group California 9 years, 5 months ago

Hi, I’m thinking of opening a home bakery in the Bay Area, and am doing research on it as part of my market research class at UCSC Silicon Valley Extension. I was wondering if I could post a survey here on owning a home bakery in the Bay Area? It’s around 10 questions, and should give me useful info both for my class and my decision.
Hi Sohna, I saw your post on Facebook. You could post it in the CA group, but honestly, I don’t think you’ll get any responses from that. This community just isn’t as well-developed as the two FB groups. Likely anyone on here who would respond would also be part of those groups. I would answer it myself, except I don’t own a CFO. I hope your…[Read more]

Hello! I’m new! I’ve been making cake pops for 3 years out of my home to friends and family and I’m not expanding and making everything legit. I pretty much have everything in order for all I need to get done. The biggest confusion was sales tax for me. Every other baker I know in FL and in my area charges sales tax but I read here on this site…[Read more]
Often sales tax is required at a local level and exempted at a state level, but I’ve heard a lot of different things about Florida. You might be able to call up the Department of Revenue, talk to a different person, and get a different answer. However, it seems like the person you talked to knows what they’re talking about. Here’s one person’s…[Read more]

It’s quite possible that that’s all accurate info, and it’s also possible that they are making guesses. Ultimately, you need to get whatever they determine you need to get. I think you could start by bringing a copy of the law and making sure they are completely familiar with it. You could also contact nearby counties to see how they are handling…[Read more]

Hello and thanks for let me join the group.
I’m quite confused regarding the application of FL cottage law in some countries and cities: I am from Palm Bay and yesterday I went to the City Hall and the answers received confused me when I compare them to what we can read on the FL Cottage Law Act. first of all I just told that I cannot sell from…[Read more]Naomi L joined the group Florida 9 years, 5 months ago

No, you will need to use a commercial kitchen to produce that. http://forrager.com/faq/#commercial

FL specifically prohibits online sales, so I take that to mean that money can only trade hands in-person. You might be able to take pre-orders online, without collecting money.
