That’s awesome! An amazing opportunity for sure. Unfortunately you won’t be able to use your home kitchen to produce the cupcakes. But you’re in the fortunate position of having a commercial kitchen at your disposal! Come to an agreement with the restaurant owner, perhaps using the kitchen in off hours. I am just beginning my “cookies and other assorted sweets” home-based business in SC and am a bit nervous about the sales tax idea. My understanding is that our county does not require me to have a business license but that I DO need to get a tax ID number. Any wisdom out there?

Hi, I live in Atlanta and want to start a home based cupcake business. I’m a little confused. I can’t use cream cheese but can I use buttercream for my frosting? I may need to put cakes in the fridge before delivery but I don’t need cakes to be permanently refrigerated. Is buttercream frostings allowed.

Yes that is allowed in NM. You need to take a food safety course and depending on your area, you might need a permit from the health dept as well. Read through this page, especially the Business section: https://forrager.com/law/new-mexico/
