Commercial food processing laws are fairly complicated and often county-specific. You should direct your questions to your local health dept. Once you get your business setup, you will be able to sell in most places with relatively few restrictions.

You don’t need it in the lease agreement (unless your landlord requires that), but it’s really a moot point since you can’t sell homemade vegan burgers anyway.

I really don’t know. This is a very county-specific determination. Sometimes it’s as simple as a written note signed by your landlord. Start by asking the ag dept about it.

With the exception of some types of baked goods, anything that requires refrigeration cannot be made in a home kitchen and sold. Therefore, almost all types of vegan burgers would not be allowed. http://forrager.com/faq/#commercial
You need your landlord’s permission before you can run a business from their property.

My son and I are writing a business plan for a small business that would offer a variety of homemade sausages, yes?
Due to the fact that we are dealing with meat appears to exclude us from operating this as a cottage industry, is this correct? Is there any way that you are able to acquire a license that would allow us to prep and make the…[Read more]

I have a question about selling homemade pasta. I did not see it listed under the covered food items and I am just wondering exactly what category it would be in. I have a restaurant that is willing to carry my product but I am not sure if I can make the pasta from home or if I need to use the restaurants facilities. I would also like to…[Read more]
If you’re talking about cooked pasta, then that’s definitely not allowed. But it looks like Ohio also doesn’t allow dried pasta. So you’re only option would be to go commercial. http://forrager.com/faq/#commercial

Your homeowners insurance will almost certainly not cover your business. http://forrager.com/faq/#insurance

Hi David, I would like to tap into a certain market by preparing chocolate dipped pretzels, cookies, or rice krispy squares once a month in my community via mail order or word of mouth. These items would be produced in my kitchen which has no carpeting, but I have a dog. What kind of licensing do I need to proceed?
If you want to ship your products, then you need a commercial license. http://forrager.com/faq/#commercial

I’d prefer to answer your questions on the site so others can benefit from the info. If you have questions beyond that, you should call your health dept.

You need a commercial license and can’t produce at home: http://forrager.com/faq/#commercial

Hello, I am a veterinarian interested in using Chinese Medicinal Herbal formulas in my practice. The formulas are made by a Chinese herbal pharmacy in Florida and are not available for purchase by the public. Would they be considered herbs under the cottage food laws, or are they considered medicine (and thus need sales tax)?

My wife and I are considering marketing our baked beans. Do they fall under the cottage law if they are canned and do not require refrigeration until after opening?

There is no way for you to sell a homemade sausage, unless you build a separate commercial kitchen in your home (very expensive). If you want to keep your costs low initially, you should find places where you can either rent or borrow the use of a commercial kitchen, such as at restaurants, churches, etc. No matter what, you will not be able to…[Read more]
