Yes you would need a license from the ag department, and you would need to produce the food in a commercial kitchen. https://forrager.com/faq/#commercial

Hi all! So I have a question regarding fish. My husband smokes wild caught fish (squaw candy as he calls it) and has expressed a desire to maybe try selling it. Does this count as a none perishable under the cottage law or, because it is fish will it require inspection and licensing?
