Hola Haimara, asumiendo que tu torta no requiere refrigeración, toda información respecto a tu negocio suena bien y sin ningún inconveniente. Siempre y cuando tu producto esté apropiadamente etiquetado, no tienes que dar factura por cada venta. Por igual, no necesitas cobrar impuestos.

I have a questions…
I have entered into agreement with local hotel to provide them with wedding cakes for clients having their reception there (they do not have a pastry chef). I am trying to get some venues set up that I can sell at under the cottage law but every farmers market that I have contacted in my area are stating that they do not allow. I guess I am beginning to wonder what the purpose of the cottage law is if there are no venues to use. Would anyone know of a way to get my product out there to the public?

Yeah it is frustrating, but farmers markets do have the right to turn away CFOs.

You can only use your own home kitchen for your cottage food business. If you wish to use a commercial kitchen then you’ll need a commercial license.

I have a question please, David. Am I capable of selling sugar cane syrup under the cottage law? Also, what about “pumpkin” and “zucchini” breads, can those be made and sold under the cottage law? So happy I found your blog, great information shared. Thanks so much!

Sweet breads are allowed, and I’m not sure if they would consider the syrup a preserve. I doubt they would allow it, but you can ask them: 850-245-5520

If you’re offering the item in-person after receiving a donation for a nonprofit, then there may be an exemption for you: http://forrager.com/faq/#nonprofit

I don’t think it matters what kind of nonprofit it is… if you’re shipping homemade food around as part of a business then that’s not allowed.
Even though online sales aren’t allowed, paying thru PayPal in-person still maintains the spirit of the law and I would say it’s okay to do that. It’s really not much different from using PayPal Here, and…[Read more]

You do not need Food Manager Certification. I usually recommend that even if not required, CFOs still take a food safety class, but it sounds like you’re already pretty knowledgeable about that stuff.

I believe that you can, but you should probably check with the county’s health dept first. For instance, I know that Miami-Dade won’t allow any cottage food sales, but that is the only county I know of that prohibits them.

No, this would be considered an indirect sale, and there is currently no legal way to sell homemade foods indirectly in Florida.
