Generally speaking, pet treats have special requirements and are not allowed in the cottage food industry. Technically, a state could allow them, but I haven’t seen one that has yet. Often the phrase “food for human consumption” is in the law language. You could try checking with your ag or health dept though and see what they say.

Generally speaking, no. You must make the products in your home kitchen only — i.e. the kitchen in the place where you live. A separate building wouldn’t work because you don’t live in that building. Kathleen, you’re right… it is strange that sales are allowed at farmers markets and not from home, and yet, a number of states have restrictions like this. Fortunately most allow sales from home too.

Nicole, you are not required to get a license from the health department to sell your food, but it’s very reasonable for your farmers market to require a business license. Mitchell, it depends on your state but the short answer is technically, probably yes, you do have to get a permit even for one day. Some states don’t require sellers to need a permit to produce cottage foods, while others totally prohibit this kind of sale — they don’t even allow home sellers at all.

April, I’m not the ultimate guru on this but I did a little research for Florida (I’m more familiar with California’s tax laws, but Florida’s look similar). The bottom line is that it doesn’t look like you need to charge sales tax.

Sandy, I personally know many cottage food operations in CA that make caramels and have had them approved. However, some counties are a little stricter than others, but I still don’t think any would say no. What county are you from? Of course, the only way to know for sure would be to talk to your county’s environmental health department.
