I currently bake an assortment of goods and have specialty pastries that I make and sell out of my home. I am unable to work a regular 9-5 job and when I get orders this helps me to supplement my income.
Since there is no Cottage Act in my state, does this mean I am operating illegally??

Yes. Montana seems to be a bit more relaxed on their laws, so you might check with the health dept to see if they are okay with you running this business.
