David Crabill replied to the topic Bartering within cottage food law limits in the forum Business 7 years, 10 months ago
I do not think that any cottage food law is sophisticated enough to specify bartering transactions as monetary transactions that count against your sales limit. If it were me, I’d only count monetary transactions against the sales limit, and I’d be highly surprised if ignoring bartering transactions were illegal.

David Crabill replied to the topic CFO Online Directory in the forum Business 8 years, 1 month ago
This website has the most comprehensive statewide directory available: http://forrager.com/cfos/?regions=california
There isn’t any statewide, govt initiative to list all CFOs, but there are a few health depts that have lists of CFOs in their counties. Off the top of my head, I think Sacramento, LA, San Bernardino, Orange, and a few others have a list.

I was wondering if I could set up a tent in front of a school in Hillsborough county, and who would I contact about the legalities?

Hi,
You can opt for mobile payment services. Certain Merchant services provide mobile payment processing app that can accept payments online. The customer also receives an e-receipt. I am using the Virtual terminal for online payments. I think the process is pretty much the same.Abel joined the group Business 8 years, 2 months ago

Correct, it’s almost always illegal for someone to operate a restaurant in their neighborhood, even a small one. When these services get large enough, they have to answer to regulators. One Bay Area service like this (Josephine) recently got shut down by the health dept because they were growing very quickly.

Self-employment tax includes social security tax. That’s the tax you pay in your quarterly estimated tax payments as a business. If you earn under a certain amount, you don’t need to pay quarterly.

Yes, you need a license and you need to use a commercial kitchen. http://forrager.com/faq/#commercial

I just checked out CFR 21 again, and although that is usually pretty confusing to me, it does look pretty clear that a blackberry jam needs a 47/55 ratio. Also, this seems correct to me… jams and jellies typically need more sugar than fruit.
In the case of the CFO jams you’ve seen in the market, that’s likely a mistake by the producer. In the…[Read more]

I’m sure it will depend on your state laws and what the health or ag dept in your area decides. I doubt that you can do this with a cottage food law, but perhaps some states would allow it.

Usually schools have strict rules about food that can be served on their premises, so I doubt you could do this without using a commercial kitchen. You should talk with the school and the ag or health dept.
