I have a questions regarding making doughnuts in the state of CO. First question, do doughnuts fall within the cottage law in CO and second question is what are the limits if any, regarding filled doughnuts as in Jelly, Jam and/or frosting. Any advice/help is greatly appreciated, thank you.

No, you can only sell food from your home if your cottage food law allows it. A few states do allow CFOs to use commercial kitchens if they want to, but the items you can sell from home would still be limited to those your cottage food law allows.

Hello, trying to start up a small business with cakes in a jar I have been doing for my family and friends. I know I cannot use any creams in the jars just shelf stable frostings? is this correct? also wanted to know if I’m allowed to make hard candy apples? Is fruit allowed such as an apple covered in hard candy?
Yes, you should be able to sell jarred cakes with shelf-stable frosting.
You can sell uncut fruit and you can sell hard candy, so I assume that if you combine the two, that would be allowed. If you cut the apple, it wouldn’t be allowed, and even putting a stick in it might be a problem. You can call the ag dept to check.

Joanne, off the top of my head, I don’t know of any that specifically allow jams and jellies that do not fall under Part 150 of CFR Title 21. Maybe Wisconsin? Their law is pretty loose when it comes to canned goods. Of course, there’s always Wyoming, which allows almost anything.
