Actually candy may be one of the only items for which you do need to charge sales tax. For some reason, most categories, like baked goods, are exempt, but candies often specifically require sales tax. At least that is true in other areas of the country. I’m not entirely sure for your area and your situation.

In Florida, an inspection can only happen if a customer has a health concern/complaint. I have never heard of that happening to any CFO across the states… at the very least, it’s exceedingly rare.

Often sales tax is required at a local level and exempted at a state level, but I’ve heard a lot of different things about Florida. It’s quite possible that that’s all accurate info, and it’s also possible that they are making guesses. Ultimately, you need to get whatever they determine you need to get. I would think that most simple sugar decorations would be allowed. Anything requiring refrigeration would not be allowed. If your decorations have dairy in them, I’d recommend you call the Bureau of Food and Meat Inspection at 850-245-5520.

It sounds like it’s time for you to go the commercial route. The cottage food law was mainly setup as an easier avenue for someone to start a food business. I would assume that if you wanted to get bigger, you wouldn’t want to be restricted to the $15,000 sales cap of the cottage food law anyway.

FL specifically prohibits online sales, so I take that to mean that money can only trade hands in-person. You might be able to take pre-orders online, without collecting money.
