Hey, can I sell my goods for fundraising purposes for my daughters sport? So, I would sell, by taking pre-orders, and then give a percentage to a booster club.

Mariana, Miami Dade is the only county I’ve heard that disallows cottage food operations, but there may be other counties that disallow them as well. Once you go over the $15K limit, you need to get a commercial license: http://forrager.com/faq/#commercial
Requirements vary based on where you live, but here’s some general info on getting the…[Read more]

Neither of those would be allowed because both require refrigeration. You need to use a commercial kitchen to produce these items: http://forrager.com/faq/#commercial

Often an EIN isn’t required for a company that doesn’t hire employees, but you might as well get one if your county is asking for it — it’s very easy and free. You can register as a sole proprietor when you apply for your business license, though some businesses opt for a corporation: http://forrager.com/faq/#llc

Angel, have you read the info on this page: http://forrager.com/law/florida/
I think that will answer most of your questions, and here’s some more info about getting started: http://forrager.com/faq/#startingYou will need to make sure that the goods you make do not require refrigeration, and all of your sales will have to be in-person. Let me…[Read more]

Hello I am looking for information on the legality of selling baked goods in public. I will be making the goods in my house and they will mostly be vegan recipes. They will be prepackaged such as being wrapped in saran wrap (plastic wrap) and labeled with the ingredient list. I am wondering if I need either a permit and/or license to do this and…[Read more]

No — you can only sell at your home, markets, roadside stands, and via delivery to event venues.

Have you called your health dept yet? Most of the questions you asked don’t have general answers and would be determined by your county or city. It’s not necessarily true that you can run your food business under the LLC that you already have, though sometimes corporations can have multiple businesses associated with them. Basically you just need…[Read more]

Hi All, I will be selling homemade salsa’s at our local farmers markets here in Orlando, but I am having a heck of a time getting straight answers on what exactly I need. Finally this site has told me I do not fall under the Cottage Food Law(unfortunately) but I have a couple questions I was hoping I could get answers to. I will be making my…[Read more]

Neither of those are allowed under the cottage food law. There may be another exemption for selling eggs (check with the ag dept), but I’m pretty sure you need a special license to sell unpasteurized milk (if it’s possible).

You don’t need a license from the health or ag depts, but your county still might require other licenses/permits, like a business license. And even if they don’t, the farmers market itself may require certain permits. Farmers markets also have the ability to turn you away because you’re homebased, even though you’re a legal business. So it could…[Read more]

So to clarify, you would sell products by following the cottage food law, and then you would choose to give a portion of your profits to the booster club? I don’t see any problem with that. Are you asking whether you can advertise or promote your business/products by telling customers that you will give a portion of the proceeds to a cause? Yes,…[Read more]
Excellent news. Yes, to both of your questions. I was double checking on the whole pre-order thing, I guess. Thank you, for your help, David.
I don’t think there’s any problem with pre-orders, so long as they don’t happen online.
