Elizabeth, the last lesson in my free mini course covers some of this. But basically, yes you need to pay income taxes at tax time. No matter how much you make, you have to report it as income. I personally use TurboTax to file my taxes, but most tax software will be able to handle business income.

I’ve heard that St. Louis restricts cottage food businesses to only selling out of the home. I don’t believe any other town or city in MO restricts cottage food businesses in that way. I’m not aware of any restrictions on either, though it would be possible for a county to add restrictions on pickup due to zoning laws.

The rules get fuzzy when it comes to things with alcohol and items with health benefits. It would probably be best to directly contact the health dept about this.

As far as I know, the rules for Hawaii haven’t changed recently. The reason many states don’t allow canned foods is due to botulism concerns, which could potentially be deadly. The lawsuit exemption only covers baked goods. The pickle bill only covers canned goods. Most states have some kind of exemption for selling honey, but that might not apply to flavored honey. I’d recommend contacting the ag dept about that. As for vanilla, you’ll likely need to produce that in a commercial kitchen in order to sell it legally.

Yes, Florida is one of the only states I know of that has a special exemption for boiled peanuts. Must be a big thing down there! :)

LA’s law is one of the most ambiguous, but yes that all sounds about right. It’s not really clear whether you can also deliver certain items, from what I’ve read.

It depends on what state you live in. 18 states allow in-state shipping. Most of the people selling homemade food on Etsy are doing so illegally.
