The law says that only direct sales are allowed, which I take to mean that the producer needs to hand the product to the consumer. It may be okay for a family member to deliver the product, but maybe not. Thanks for the kind words! I do just want to throw out a word of caution for Illinois, in case you’re concerned about being legal. I believe there are only a couple counties in Illinois that allow sales of homemade food outside of farmers markets, so you might want to check on that.

First of all, I think it’s unlikely that savory jams would be allowed under this law. The types of canned goods you can produce must have an appropriate combination of sweet and/or acidic. I don’t think there’s an instance where your jams or jellies could include vegetables. This resource should help explain what’s allowed.

FL specifically prohibits online sales, so I take that to mean that money can only trade hands in-person. You might be able to take pre-orders online, without collecting money.

Okay, that makes sense, and since it’s regulated by the USDA, not VA’s ag dept, I can see how the home food processing license would not be sufficient. Thanks for the info!

I believe that your zoning manager can prevent your home business, but in this case, it sounds like he may just be unfamiliar with the law. I’d recommend you call the state ag dept and try to connect the person there with your zoning manager, so he can understand that these home businesses are legal, and even common.

The ag dept is responsible for enforcing the cottage food law, so if they don’t know, then I sure don’t. You basically need to find out if they will allow you to make food with alcohol in it, and if so, do you need to get an alcohol license? You can also try contacting the Alcohol Division to see if they know.

Thanks so much for replying. So I take that to mean that even a commercial operation, processing the milk in a commercial facility, cannot sell it? Then there would be no way for anyone to produce goat milk and sell it in a store in VA? Very interesting.

Gina, you make good points and the limitations of the cottage food law are definitely a good reason to seek a commercial kitchen. Commercial kitchens are so much better equipped to handle the needs of a food business, and once someone runs a full-time business or can afford a commercial kitchen, I agree that those are the way to go.

Often sales tax is required at a local level and exempted at a state level, but I’ve heard a lot of different things about Florida. The ag or health dept doesn’t issue CFO certificates. The only definite requirement that I’m aware of is the sales tax certificate: http://forrager.com/law/louisiana/
