I think it’s going to depend on what county you live in. I know that some counties would definitely allow potato chips. But since it’s not explicitly written into the law, maybe not all will. You’d need to reach out to your health dept to check.

You can usually sell fresh, uncut produce without needing a permit. I believe that businesses can use your produce, but some counties have restrictions on accepted sources of produce. You can check with the health dept to see if that’s the case in your county.

It’s quite possible that they would not be allowed, given the egg content of macarons, but you have to check with the health dept. If they’re not allowed, you’d need to use a commercial kitchen. http://forrager.com/faq/#commercial

No — the cottage food law is only for in-state sales. You also wouldn’t be able to cook from a kitchen in CA and try to use CA’s cottage food law, if you’re living in Nevada. You need a commercial license to sell out-of-state.

No, pumpkin pies are not allowed. There is sometimes confusion because you might see a table of unrefrigerated pumpkin pies for sale at Walmart. However, these pies have chemicals in them to keep them stable, whereas homemade pies need refrigeration.

Erik, all your food prep needs to happen in your home kitchen. You can give out samples, but they need to be prepackaged at home. To make the samples on-site, you would need a different kind of license.

Annette, all of the info I know is on the Nevada page. Unfortunately, the government agencies haven’t put much info online yet. You should call the health department in your county and see if they know about the law yet. They are the ones that need to get you registered.
