Yes but NJ is the only one left according to the map.

You should contact the ag dept about selling the teas and syrups… I don’t think you can sell them from your office. I believe you can only sell them at certain public markets and stores, so you might need to produce them in a commercial kitchen to sell them at your office.

Usually the two factors working against cottage food laws are health depts and existing businesses. Why is NJ not passing the law? I don’t understand this at all. The last state with no law, what is the reason? Many people would benefit.

Technically both states’ laws could govern the sale. At the very least, the laws for your state will come into play, which means that you wouldn’t be able to sell any homemade food, even if it was sold out-of-state.

I have a food product I’d like to make myself and sell. I’m from New York, but I live in Shanghai most of the year. I’m not sure how to sell in Shanghai (a topic for another post), but I’m wondering whether it would be possible to sell foods internationally to customers in New York (and California) via the internet.

Usually there are no ag dept licenses for selling your own produce, but when it comes to selling others’ produce, I simply don’t know. You should call your ag dept for more info.

Yes, that’s doable but usually quite expensive and complicated. It’s likely that the commercial kitchen would have to be separate from your primary kitchen. Unless NJ has very lenient standards, you can expect to pay thousands or tens of thousands of dollars for that remodel. No, NY isn’t really setup for a custom food business, since they only allow sales at events and stores. The law is intended for a home cook who makes items and then brings them to an event and sells them there, or sells them to a store for resale. Yes, as long as you’re using a commercial kitchen and have the appropriate licenses from the health dept and county, you can sell your hot sauce. You need to call your health dept learn about the steps to become a commercial food processor.

Yes, you should be able to sell jarred cakes with shelf-stable frosting.
You can sell uncut fruit and you can sell hard candy, so I assume that if you combine the two, that would be allowed. If you cut the apple, it wouldn’t be allowed, and even putting a stick in it might be a problem. You can call the ag dept to check.
