Thank you for responding David.
I got a reply back from someone from the TN.gov office. They don’t know how to handle this either. They’re trying to get some information for me.

It’s a unique setup, for sure. I don’t think I’ve heard of anything quite that elaborate, though I do know CFOs who pool money to buy ingredients wholesale from existing suppliers.
I can’t claim to know anything more than UT’s ag dept, so you’ll have to wait for responses from them, but I will say that a number of states are fine with flours and…[Read more]

I’m very new to the Cottage Food law, so I started with Agriculture Dept of the UT. I started there because my husband and I are developing a coffee house in Clinton, TN. We ran into a problem with finding organic ingredients wholesale. No one would accept our restaurant for wholesale purchases because we couldn’t meet their minimum order…[Read more]

Am new here, not too good at navigating site yet…..just wondering about how to handle deliveries to customers…..not sure if I want people coming to my house all the time to pick up items…..time is everything and I don’t see how it could ever be profitable if everytime someone picks up it turns into a “visit”??? Also the time involved if you…[Read more]

As long as all of the proceeds go to the nonprofit, usually there is an exemption that you can use: http://forrager.com/faq/#nonprofit

Some farmers markets are produce-only, but I’ve seen many CFOs successfully sell baked goods at the markets that allow them. I’ve seen two distinct approaches: the niche approach and the bakery approach. The former focuses on a few select products, and the latter offers an array of baked goods. The former can command higher prices but the latter…[Read more]

Just wondering if anyone has any advice on selling baked goods at local flea/farmer’s markets? I know that produce sells pretty well, but I’ve not seen a lot of baked goods (not here in AK anyways). There are, however, quite a few local markets in my area; and I was thinking it might be worth a try. I’m still not sure, though…so I wanted some…[Read more]

Since you are making the sale, this is an indirect, out-of-state order. She needs to have a license that will allow indirect and out-of-state sales, which may not be allowed with a TN domestic kitchen license. There’s a very good chance that she will need to open a commercial bakery in order to do this. Unfortunately, I can’t give a definitive…[Read more]

Sales need to be made directly between the customer and producer. A farmers market wouldn’t be able to take orders on the behalf of a vendor. A producer could probably do a paper order (pre-order) one week at the farmers market and collect money then, and then fulfill the order at the next week’s market. But I don’t think anything beyond that…[Read more]

Kathleen, it depends on your state, but if the state only allows direct sales, the likelihood is that you cannot offer CFO products. CFOs are often explicitly not food facilities, and food facilities cannot offer their products for sale. I don’t think your would be considered a public event unless the market happens at a specific location.…[Read more]

I left some more info in my response to your comment on the law page, but basically, the relationships you establish with customers are everything. My suggestion would be to wait until this is actually a problem before worrying about it.
