That’s all correct. You could still try contacting your health dept to see how complicated it would be to serve coffee… you might not need much more than a sellers permit. Montana has actually specifically allowed hot coffee and tea in addition to their cottage food items.

Am I correct in assuming we cannot provide brewed coffee samples or sell a cup of brewed coffee to a customer in order to sell dry roasted coffee beans? I suppose the scent of the roasted coffee beans would be the selling point rather than the brewed coffee for a Cottage Industry provider? I am in Escambia County, Florida. Thank you.

Thanks for posting this Cristina… I really hope you can help improve things. Let me know if I can help in any way… for instance, I can provide examples of how other states have added a line to their law to prevent counties from disallowing CFOs.

Yes, all the rules that are on Florida’s page. Also contact your planning division to make sure your region doesn’t have any other requirements. And Miami-Dade county is currently not allowing cottage food operations, in case you live there.

April, I just want to further clarify my response. I still think that you are exempt from all taxes, but since I wrote this answer, I have learned that in some states, only state taxes are exempt, and local (city and/or county) taxes still apply to cottage food sales. I make jams and preserves, but I also make soaps and other bath products which I plan to sell at a local market under appropriate licensure for Florida.
