I think I know the answer but couldn’t find it explicitly written in FAQs. Can someone sell peanuts mixed with batter then fried under cottage law? There’s an awesome Indonesian “peanut cracker” called rempeyek kacang that’s very popular at parties and festivals. Typically people pre-order and pick up at event. We’re sponsoring an event and…[Read more]

I would say that getting insurance will protect you more than an LLC would. If you haven’t already, you’ll want to read these FAQs:
http://forrager.com/faq/#insurance
http://forrager.com/faq/#llcI do not think you can do what you suggested. However, it’s worth noting that the “no LLC” info came from this report, which seems extremely wel…[Read more]

I read that my cottage food business must only be a sole proprietorship. But would registering my business as an LLC, while still keeping the tax benefits of a sole proprietorship qualify my business as a sole proprietorship.
If not, how are food cottage businesses protected from business liabilities (as in an LLC)?

Aimee, I’m not entirely sure. This seems to fall into a gray area, because it’s neither an indirect sale nor a direct sale, really. My guess, which could be wrong, is that this would not be allowed because you are not selling to the end consumer. I’d recommend you call the state ag dept for official clarification.

Hello! I’am starting my new cottage food business in Seminole County, Florida. I will be baking Bundt Cakes, cupcakes and muffins… Recently a lawyer office ask me if I can sell them a certain amount of muffins weekly so they can give them away as a gift for their clients. Can I do that?

From what I’ve heard, Miami doesn’t allow any types of homemade food to be sold. Miami-Dade County has banned the cottage food law. http://forrager.com/faq/#commercial

I want to make sure I am taking care of all of the legal aspects of starting a cottage food business. I live in Jefferson County. What taxes do I have to file and how often. Do I charge sales tax? What other government documents will I need to file? Thank you.
Lisa BletteI’d like to help, Lisa, but this is really all info you need to get directly from your county. There is some info about sales tax here: http://forrager.com/law/colorado/#business
Thank you David.

Looks like only 5 of us in this group (Colorado). Is this a new platform?
It’s still relatively new. The cottage food movement is also still relatively new. Forrager doesn’t yet have tools that would bring people back to the site (like resources for existing CFOs), assuming that they’ve already gleaned the info they need from it.
However, if you pose a question to this group’s forum, that should go to the members in…[Read more]

The limit isn’t actively regulated, but a health or ag dept could shut down an operation if it was clear that they were making too much. I’d say it’s more self-regulated, in that people know if they make more than $15K then they’re doing something illegal. That limitation is baked right into Florida’s law, so an amendment to the law would need to…[Read more]

Bake sales like this may be possible, but it’s up to your health dept to draw the lines for what’s allowed.

One thing that complicates things is that CFOs do not need a permit from the ag dept, so most probably don’t check with the ag dept before starting their business. But from what I’ve heard, in Miami-Dade a CFO would get stopped if an inspector walked through the market.
It is actually what the law doesn’t state that matters. It doesn’t say that…[Read more]

No, you can’t fry your products. You would need to bake a batter like that.
