CO just amended their law and is unlikely to follow suit anytime soon. It sounds like you will need to build a commercial kitchen, either on your property or elsewhere.

Actually candy may be one of the only items for which you do need to charge sales tax. For some reason, most categories, like baked goods, are exempt, but candies often specifically require sales tax. At least that is true in other areas of the country. I’m not entirely sure for your area and your situation.

In Florida, an inspection can only happen if a customer has a health concern/complaint. I have never heard of that happening to any CFO across the states… at the very least, it’s exceedingly rare.

The law says that only direct sales are allowed, which I take to mean that the producer needs to hand the product to the consumer. It may be okay for a family member to deliver the product, but maybe not. Often sales tax is required at a local level and exempted at a state level, but I’ve heard a lot of different things about Florida. It’s quite possible that that’s all accurate info, and it’s also possible that they are making guesses. Ultimately, you need to get whatever they determine you need to get. Thanks so much for the update! It appears that the bill was amended before it got passed. The final version increases the sales limit to $10,000 per product and does not allow small businesses to resell cottage food products. This bill was signed on 5/1/15 by Governor Hickenlooper. Here’s a link http://www.legispeak.com/bill/2015/sb15-085. The basics are gross sales from an eligible product went from $5000 to $20000 and it also says CFOs can sell to small businesses as well. I guess other changes could be made before Aug 5, 2015 when its supposed to go into effect.

You can only sell to customers in CO, but you can’t ship to anyone. However, you can sell online, with local fulfillment. Many CFOs run successful businesses with this local approach, without needing farmers markets. However, it may take more marketing effort and outreach on your part.

Hi, I want to clarify about having a website…if there’s something on the website that says we can only sell and ship to customers within Colorado is that allowed? I know nothing about marketing so I’m not sure how to go about advertising about our products. Farmers markets in Colorado are over by October.

FL specifically prohibits online sales, so I take that to mean that money can only trade hands in-person. You might be able to take pre-orders online, without collecting money.
