David replied to the topic Sellers Permit in Los Angeles California in the forum California 11 years, 8 months ago
I believe it’s the state that issues seller permits, but I’m not sure if you need one. I know some counties require them, and fortunately they’re free. Even if your county doesn’t require them, a venue you sell at might require them. I know some CFOs get one just in case. The environmental health dept can tell you if they require thme.

End-of-year income tax is going to be based on gross sales, and probably as a self-employment tax. You just add up the total sales, remove your deductions, and your tax program should tell you what you owe. If you make enough money, you may have to submit estimated taxes quarterly.

Yes, if you have a commercial license from the health dept, you’d be relatively unrestricted.

Yes, you can do any direct sales to customers.

You mean food stamps? I really don’t know.
David replied to the topic Do I need to form an LLC? And nutritional labels in the forum California 11 years, 8 months ago
You can run it as a partnership, but each business has the $45,000 sales restriction, so that’d be $22,500 of sales (not profit) max per person.
The requirements don’t change much for Class B. You need to get an inspection so you can sell to stores and restaurants, and you can only do those indirect sales within your county, unless another county…[Read more]

I have a question. If i mix up my cookie batter at home can i bake them fresh for the customer at the farmers market with my portable cookie machine.
No, you must make, package, and label everything in your home kitchen. You can’t even have pieces of (cooked) cookie sitting on a plate for people to try… even your samples must be individually packaged in a sealed container in your home kitchen.

I am seriously thinking of starting my own cottage food business. The one lingering question I have is, do I need to do an LLC right out of the gate? It scares me that someone might personally sue me should my food make them sick. And yes, I would have insurance to cover in that event. Should I see if I can sell anything first before taking the…[Read more]

To make even $1 of profit, you need to follow the cottage food law described on this site. That will entail talking to the health dept, registering, submitting labels, etc.

No, deep fried foods aren’t allowed at all, whether they’re fried on or off site.

Thanks David – even though it wasn’t the answer I wanted to hear ;). What kind of license would I need to obtain to be able to sell homemade salsa at fairs and festivals?
David replied to the topic Is salsa eligible? in the forum California 11 years, 9 months ago
That’s correct — salsa is not allowed.

Hi David – thank you so much for putting all of this together. I currently make (but do not yet sell) jams and jellies. I would like to sell salsa at craft fairs later on. From what I have read on your site here, salsa would not be eligible for the class A cottage food permit. Is my assumption correct?
