Although kombucha isn’t allowed under VA’s cottage food law, you should still talk to your health dept to see if there’s a way you can bottle it at home and sell it. Otherwise, you’ll need to use a commercial kitchen.

I am not familiar with any significant websites for Virginia.Most people make labels themselves and print them at home. Some also use online print shops to produce their labels.

You should call Heath at the ag dept at 804-786-1164, and he should be able to clear up most of your questions. You can probably make buttercream frosting, but I’m not sure about that, since sometimes depts disallow it. I am just starting up a cake business from my home. I only use buttercream frosting. Would I fall under the Cottage Food Law and if so what steps do I have to take to make it “legal” for me to sell my cakes? I am very new to this and very confused by all of the things I have read and I do not want to make any mistakes. Thank You

You can sell dry tea with the cottage food law, but you can’t sell homemade brewed tea. If you want to sell (non-homemade) brewed tea outside of your home, you’d need a commercial license: http://forrager.com/faq/#commercial
You should call your ag dept to make sure there aren’t any exemptions you can take advantage of.

You will probably still need a business license if your county requires it. However, using the cottage food law will help you bypass a lot of the strict requirements from the health dept, like inspections. I’m not entirely sure if they will allow buttercream frosting, though… check with your ag dept.

I make Salted Caramels at home and typically would give them out to friends and co-workers. Recently a boutique store wants to offer them. I also want to be able to sell them online. I take it this would fall under commercial and not cottage laws, right?

Yes — you should contact your planning division and see if there are any local requirements, like a general business license.

That’s right. VA only lets you sell at farmers markets and from home (including delivery).
