    Hi – I am a member of a cooperative market. We sell local meats, produce and dairy to our members. We have some Cottage food operators and are not sure how that works in conjunction with us. We do sell agriculture products, are open to the public, and operate out of a food level 1 facility for our distribution. There is a one time membership joining fee to the coop but anyone can join. We are on the fence as to whether we can or cannot sell cfo products as the ‘public events’ label is pretty vague.

    Kathleen, it depends on your state, but if the state only allows direct sales, the likelihood is that you cannot offer CFO products. CFOs are often explicitly not food facilities, and food facilities cannot offer their products for sale. I don’t think your would be considered a public event unless the market happens at a specific location. Ultimately though, you need to contact the health or ag dept to determine the requirements for your area.
