Can Cottage Food Law apply if building is not attached to the home?

    Hi. I currently have an established meat processing business (deer). I am interested in packaging and selling our dry rubs and sausage/jerky seasoning. The mixes should fall under the Cottage Law but does it matter that they would be sold from the building the meat processing business is in? Its on the same property as the home. Also, it us USDA inspected and we have a business license for it. I’d like to turn the office into kind of a store front for our customers and offer these mixes for sale when they pick up their meats. Thanks.

    Jean, you cannot be the owner of both a commercial food business and a cottage food operation. It sounds like even though the items you are selling would fall under the cottage food law, you will need to get a commercial permit to sell those items, which should be much easier for you since you already have a commercial kitchen setup.
