Food trucks are kind of in a class of their own. In the case of a retail store, the shop owner has the proper licenses and insurance and they are allowed to sell your products themselves. No, you cannot sell there even though it’s your shop. You would need to produce the items under a commercial license to sell from your store. http://forrager.com/faq/#commercial

Did the ag dept tell you that? If not, I’d recommend you call them to confirm. If that’s true, you might need to hire a lab to test your alcohol content.

I know it seems weird, but actually those kind of prohibitions happen all the time across the country. The cottage food law doesn’t omit Charleston… the city does. You can sell certain types of goods that don’t require refrigeration using this law: http://forrager.com/law/south-carolina/
You can sell lemon pies, but not lemon meringue pies, since those require refrigeration.

If the retail location is a food establishment, then I’m almost certain that you can’t sell there, even though you own it.

I know you need a business license and you need to file taxes every month. I don’t know if they require you to get an EIN… usually you only get one if you are an employer of others, but sometimes it’s necessary for other reasons. You should ask about that when you apply for your business license.

As for your question about renting your house you might need to talk to your landlord to make sure having a business in your home is not in violation with your rental agreement.

That wouldn’t be allowed since SC only allows non-perishable foods. A baked potato needs to be refrigerated to keep it safe. To sell baked potatoes legally, you would need to find a commercial kitchen to use and get the proper licensing from the health dept.
