Did anyone have to register with the Dept of State after going through the Dept of Ag. for their license? I opened a bank account with an EIN number for the business and my banker says I need to do this now. (https://www.corporations.pa.gov/)

I’m almost positive you need a permit to do that, but I’m not sure which one. You could do this as a limited food establishment, but you should call the ag dept to see if there’s an easier way.

I believe that your zoning manager can prevent your home business, but in this case, it sounds like he may just be unfamiliar with the law. I’d recommend you call the state ag dept and try to connect the person there with your zoning manager, so he can understand that these home businesses are legal, and even common.

Unless there is some special permit for repackaging commercially-produced foods, I think you would at least need to become a limited food establishment — I think those foods would be allowed, but I’m not completely sure. It’s best to contact the ag dept directly and ask them about your specific situation.

You need a commercial kitchen to do this, and it wouldn’t fall under the cottage food law. It’s only possible to do at home if you build a commercial kitchen on your property. http://forrager.com/faq/#commercial

I have a business venture that I would like to pursue (2 options). I want to prepare meals for people with different needs, primarily gluten free. I don’t know if this falls under PA Cottage Law? I would like to get an inspection (whatever type applies) prepare and package the food in my home. The meals would be delivered to my clients once a…[Read more]

Jenn, usually the only way to find info about this is to call the govt dept directly.

Jay, I’m pretty sure that your equipment doesn’t need to follow commercial standards. You should call the ag dept to make sure.

I don’t know, but most people also need to get some form of business license before they can start running a business. I would have thought that the ag dept would mention other requirements when you applied. http://forrager.com/faq/#starting
