I haven’t seen any rules published by the Ohio ag dept, but generally, you should be individually packaging your samples in your home kitchen, and they should be opened by the consumer. This would probably be fine, especially if you use water instead of milk. Since there’s a very small amount of milk, it’s possible that the sugars in the cookie dough would stabilize it and even that would be okay. The butter shouldn’t be a problem. My first question has to do with vinegar. It seems pretty acidic to me, can you tell me why this is exempt and why we cannot sell it? I assume we are not to sell it on or offsite? I have my own apple cider vinegar from my own apples and I would like to sell it.

Under Ohio’s cottage food law, you can’t sell online or use a commercial kitchen. You need to get a commercial license: http://forrager.com/faq/#commercial

You can make all of the things you described, as long as they don’t require refrigeration. You need to be incorporating fruits like blueberries or bananas into the batter (garnishing with fruits isn’t allowed).

Collette, I’m not exactly sure what your question is. Are you wondering if your home kitchen can be a commercial kitchen, or if you can legally operate under the cottage food law with your home kitchen?

The law says “A cottage food production operation shall not process acidified foods, low acid canned foods, or potentially hazardous foods.” Beyond that, the state doesn’t really have much published online about this.

Debbie, Ohio is usually pretty flexible with what they allow, but it doesn’t look like they currently allow mustard through their cottage food law. Sorry!

So does this mean I can do the hot cocoa mix in a jar? Sorry I didn’t catch where you answered that. I was also curious about marshmallows? Would they be considered a soft candy?
