    I recently started a business in which we make different type of confectionary delights and we have been approached by several different businesses in the area that would like to purchase from us wholesale to resell to the general public. My understanding is that under the cottage food act/law that we can not do this. This is killing our business because of that. However, the business has granted us permission to use their commercial kitchen to produce our products there. What do we need to do in order for us to be within the laws of FL to operate as a legit business instead of cottage foods? Inspections? Fees? Licenses? Permits? Etc.? This is all very new to us and we quite frankly aren’t sure because of the confusion of the laws and where to find answers to our questions about this. Anything you could provide would be greatly appreciated. Thanks!

    • There are so many different things to take care of when starting a commercial food business and unfortunately, the rules are different for just about every state/county/city out there. You won’t be able to get all the info you need without calling the health dept and your local planning division.

      However, I can say that getting a commercial kitchen is usually the biggest roadblock for a commercial food business. If you already have access to one, and especially if you don’t have to pay rent, then you are lucky, and going the commercial route should totally be worth it. There will be more fees, applications, and possibly training, but you bypass all the restrictions that come with a home-based business.
