A friend has a 401(c)(3) animal rescue. She has a huge garage sale every year to help with vet bills. I’ve heard of other garage sales in our area selling Danishes & coffee, & hotdogs & Cokes at their sales. I thought that would be a good way to bring in some extra money. We would set up a grill in the driveway to cook the hotdogs & would have a cooler with canned drinks & water. One group mentioned they had volunteers make baked goods wrapped individually in baggies with a label of where they were made. Is all this allowable without a permit? We want to follow the laws. Thank you.

Making a nonperishable item, like a baked good, should be allowed under an exemption, but making hotdogs is probably not allowed. You don’t have to worry about the cottage food law, since this is for a nonprofit, but you should still call your ag dept to determine what is allowed under the exemption for donated food. http://forrager.com/faq/#nonprofit
