    Hi David – You mention on the FAQ’s page that “…most states have an exception that allows you to donate your non-potentially hazardous food items to a church bake sale or similar cause, without getting any kind of approval from the government.”

    I’m working on a paper on cottage food laws. Do you have a list of those states with a non-profit exemption? Any help you could give would be great.

    I said “most” because I haven’t done the research to prove that it’s not all. Also, some of the rules are very unofficial, while some are firmly grounded in the law. One thing is clear… it’s unlikely that any health dept would shut down a church bake sale. As far as I know, every state has such a rule, but I can’t prove that, other than the fact that it has not yet been disproven to me.
